He didn't say patents, he used the word IP which is vague. He's goal is to make vague statements to spread fear, uncertainty and doubt regarding Linux, which has been their strategy for a very long time.

Even if Linux infringes on Microsoft patents that are valid, let's not forget about the patents owned by OIN and IBM. Worst case scenario IBM buys Red Hat for very little money.</description>
