Bound to occur
July 9, 2007It’s always a bit confronting when someone ridicules one of your favourite things in the world in such a fitting way you really have nothing to say in return.
A comment [Tobus 09-07-07 @ 15:36] on an item about Avril Lavigne possibly having stolen lyrics:
Yeah, well, it remains so that 90% of all lyrics revolve around any of the following 4 themes:
- I love you
- I hate you
- I want you back
- I want to lose youInfringement cases are bound to occur.
But… But… Forget it, he’s right. Grumble.


I blogged about IP law today, but I was debating on adding one more paragraph about these guys who sued both Avril and Apple and that photographer who sued Apple about his stolen picture. My problem is this with these cases:
There are 6+ billion people in the world. People have more money these days than they had 50 years ago. More money means more creativity. Having 6 bn people creating shit all the time, is BOUND to look similar to something else. Heck, there are over 40 million songs written so far in the world. How many freaking note combination exist that are listenable??
I was having this idea about a TV series script a few months ago, and later, I found that it’s ALREADY been done in Canada in 1971! They would have sued my ass if I was going with it! Same goes for an australian short movie on youtube, that viewers replied that it was already been done 20 years ago (the creators honestly didn’t know about it).
Point is: “likeness” of an IP product to another must be extreme before a lawsuit gets allowed. And when I say extreme, I mean “verbatim”. And the reason for that is because “likeness” of a product to another in this day and age mathematically-speaking is HIGH.
